There are multiple governing documents specific to any homeowners Association. The documents specific to Seven Springs are, in order of authority (highest to lowest)...

  • Articles of Incorporation
  • Bylaws
  • Covenant Conditions and Restrictions (a.k.a. Rules and Regulations)
  • Association Policies and Procedures

It is the responsibility of the seller to provide these to the buyer. Copies of these documents (except Articles of Incorporation) are available for free downloading from this site; or can be mailed upon request for a small handling fee. Additionally the Articles of Incorporation can be obtained from the State of Colorado.

Federal and State laws supersede these documents in certain areas. There are three primary State laws that impact and affect the operation of homeowners associations in Colorado. They are typically know as...

  • CCIOA Colorado Common Interest Ownership Act (2001)
  • SB05-100 State Bill 100 (2005)
  • SB06-089 State Bill 89 (2006)

Every month the Board and our Agent struggles to make decisions related to homeowners' requests. Many of these decisions are difficult because we are all neighbors. Homeowners must realize that the Board's job is to interpret and enforce the covenants to preserve the value and harmony of our neighborhood. Neither the Board, the Agent or the existing homeowners had any part in the development of these covenants. These covenants were developed by the original Declarant of the development, The Hans Nielsen Company. The experience of the Board is that the covenants are vague and out of date in many areas. It seems appropriate that the covenants be reviewed, updated, or changed based on input from the homeowners.

Changing the covenants is a very difficult process requiring a 67% majority of Association Members and First Mortgagees. This type of majority is VERY difficult to achieve. However, the Board can pass rules and regulations to clarify the covenants or address issues/items not specifically covered by the covenants so long as these rules and regulations do not conflict with the covenants.
